1. Acceptance and Eligibility
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to enter into this agreement. If you use Kurate in your work, you remain responsible for following your organization's policies and obtaining any necessary authorization.
2. What Kurate Provides
Kurate helps users search and examine a curated research evidence base. It may assess study quality using its rubric and generate AI-assisted summaries, comparisons, citations and follow-up answers. Outputs are intended to identify and explain relevant evidence, source references, limitations and considerations so that users can independently review the basis for an output. Coverage, available features and study assessments may change as the evidence base and the Service develop.
Kurate is a research and information tool. Its outputs do not provide personalized medical advice, diagnosis, treatment, prescribing instructions, legal advice, regulatory advice, reimbursement advice, billing advice, research-integrity advice, ethics-review advice or institutional review board advice. Kurate does not replace professional judgment, peer review, clinical review, legal or regulatory review, publication review, research-governance review or any required approval process. Any professional, clinical, research, legal, regulatory, reimbursement or publication decision remains the responsibility of the appropriately qualified person or organization making that decision.
3. Interpreting Research and AI Outputs
Research findings can be uncertain, disputed, superseded or limited to particular populations and settings. Automated answers, grades and citations may be incomplete, incorrect, outdated, mismatched to the source or affected by limitations in the evidence base, retrieval process or AI-assisted analysis. A high grade or a featured study does not guarantee that a finding is valid, universally applicable, publication-ready, clinically appropriate or suitable for a particular decision.
You must check important claims against the original sources, review the cited evidence and use your own judgment before relying on, publishing or sharing an output. When using Kurate for clinical, policy, regulatory, reimbursement, publication, procurement or other consequential work, you are responsible for obtaining appropriate expert review. When sharing an output, identify it appropriately as AI-assisted and preserve the relevant source references and qualifications. We do not guarantee that Kurate includes every relevant study or the latest evidence.
4. Accounts and Sign-In
Provide accurate account information and keep your primary email address current. You may sign in using an available Google identity, a password or a one-time email code. We require verification before queries and may require fresh account validation before changes to contact details or login methods. A backup email, if provided, is a contact address and does not automatically become a login or recovery method.
Keep your credentials and email codes private. Do not share your account or use another person's account without authorization. Contact hello@kivira.health if you believe your account has been compromised.
5. Free Allowance and Follow-Ups
At launch, a standard free account includes 15 successfully completed main queries in total, with up to 3 successfully completed follow-ups for each completed main query. This is a one-time allowance; it does not reset monthly. No payment method is required.
A main query counts once it successfully completes and is saved to your account. Viewing or reopening a saved result does not consume the allowance. A deliberately requested rerun or a new evidence search uses another main query. Included follow-ups clarify or discuss the evidence in an existing completed query; further questions beyond the included follow-ups require a new main query. Failed or cancelled work that does not complete does not consume a successful-query or follow-up allowance.
After the main-query allowance is exhausted, you may continue to access your account, view available saved results and use any remaining included follow-ups on those results. Technical rate limits, maintenance and abuse-prevention controls may also apply. Authorized staff or separately agreed complimentary accounts may receive different access.
We may change allowances for future use with reasonable notice, as described in Section 13. The current allowance and remaining usage are shown in your account. Creating additional accounts, changing email addresses or deleting and recreating accounts to bypass a one-time allowance is not permitted.
6. Fees and Future Paid Services
The current free access described here does not carry subscription fees or automatic overage charges. A free account will not automatically convert into a paid subscription.
We may introduce paid plans, subscriptions, credits, enterprise access, professional services or other paid features in the future. Any future paid service will require a separate choice by you or your organization and disclosure of its price, renewal terms, cancellation process and applicable terms before purchase. If a separate order form, subscription agreement, enterprise agreement or other written agreement applies, that agreement controls for the paid service to the extent it expressly provides different terms.
7. Acceptable Use
Use the Service lawfully and respect the rights of other users, researchers and publishers. Do not attempt unauthorized access, circumvent allowances or security controls, impersonate another person, introduce malware, interfere with availability or use the Service to facilitate unlawful activity. Bulk extraction or automated use beyond the facilities we make available requires our permission. This does not restrict activity that applicable law expressly protects.
Do not submit patient-identifiable information, personal health records, credentials, confidential information, trade secrets, unpublished proprietary research, special-category personal data or another person's personal data unless a separate written agreement with Kivira expressly permits that use. Queries should concern research evidence and material you are entitled to provide. The Service is not offered as a channel for storing patient records or providing emergency assistance.
8. Your Queries and Submitted Material
You retain any rights you have in material you submit. You give Kivira permission to process, store, reproduce, analyze and display your queries, prompts, follow-up questions, submitted material, generated outputs, interaction records, usage records and feedback to provide the requested Service, maintain saved results, support your account, protect the Service and improve Kurate, as described in the Privacy Notice. This includes permission to use those materials and interactions to test, evaluate, validate, debug, develop, train, fine-tune and improve Kurate-controlled systems, including evidence-curation methods, retrieval systems, quality rubrics, AI-assisted features, user experience, safety controls and abuse-prevention systems. This permission extends to human review by Kivira personnel, contractors and service providers who need to carry out those functions and does not transfer ownership of your material.
You are responsible for having the necessary rights and permissions for your submissions and for ensuring that your submissions may be used for the purposes described in these Terms and the Privacy Notice. Where applicable law requires consent or another legal basis for particular processing, we will handle that processing as described in the Privacy Notice. Feedback you voluntarily provide may be used to improve the Service without an obligation to compensate you.
9. Privacy and Service Communications
The Kurate Privacy Notice at https://kurate-privacy.kivira.health explains how we handle account information, queries, outputs, usage records, interaction records and operational data. Research queries, submitted material, generated outputs, interaction records and relevant evidence may be processed by external AI, infrastructure, analytics, security and support providers as explained in that notice.
We may send email codes, password resets, account-security messages and service or Terms notices needed to operate the Service. Keep your contact details accurate. Marketing communications, if introduced, will be handled separately in accordance with applicable law.
10. Intellectual Property and Sources
Kurate's software, branding and original service content belong to Kivira or its licensors. We grant you a limited, non-exclusive, non-transferable permission to use the Service for its intended research and information purposes, subject to these Terms.
Research papers and other third-party material remain subject to their owners' rights and applicable licences. Access to Kurate does not grant rights to republish an article, bypass a journal paywall or claim authorship of a researcher's work. You may use and share generated outputs for lawful research, evaluation and related work, subject to third-party rights and the verification and attribution responsibilities in Section 3.
11. Availability and Disclaimers
We aim to provide the Service with reasonable care, but it is offered on an "as available" basis. We do not guarantee uninterrupted availability, permanent retention of saved results, complete evidence coverage or error-free outputs. Keep your own copies of results you need to retain.
To the extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. This clause does not remove warranties or rights that applicable law does not allow us to exclude.
12. Liability
To the maximum extent permitted by applicable law, Kivira is not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, business opportunity or goodwill, arising from use of or inability to use the Service. Subject to the exceptions below, Kivira's total liability arising from the Service will not exceed USD 100.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not allow us to exclude or limit. Nothing in these Terms overrides mandatory consumer protections, data-protection rights or other non-waivable rights.
13. Changes to the Service and Terms
We may improve, modify, suspend or discontinue features, including the free offering. We will give reasonable notice of material changes to these Terms or the standard free allowance before they apply, except where an immediate change is needed for security, to prevent abuse or to meet a legal obligation.
Where applicable law requires further agreement, we will obtain it. You may stop using the Service if you do not accept a change. The current Terms will be available at https://terms-kurate-user.kivira.health.
14. Suspension and Account Closure
You may stop using Kurate at any time and request account closure by contacting hello@kivira.health or privacy@kivira.health. We may restrict or suspend access where reasonably necessary to address abuse, a breach of these Terms, a security issue or a legal obligation. Where practicable and appropriate, we will explain the reason and provide a way to contact us about the decision.
Account closure and any retained records are handled under the Privacy Notice and applicable law. Closing an account does not create a new free allowance or override an existing legal obligation.
15. International Use
Kurate is offered for users in multiple countries, but availability of features, content, free allowances and future paid services may vary by location. You are responsible for complying with laws and professional obligations that apply to you and your use of the Service, including laws about privacy, research, publication, healthcare, professional practice, export controls and sanctions. Do not use the Service where doing so would be unlawful.
Kivira is based in the United States, and we and our service providers may process information in the United States and other countries that may not provide the same level of protection as your home country. Cross-border processing and transfer details are described in the Privacy Notice.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, excluding its conflict-of-law rules. Subject to mandatory applicable law, disputes arising from these Terms or the Service will be brought in the state or federal courts located in New York County, New York.
If you are a consumer, this clause does not take away mandatory protections available under the laws of your usual place of residence or a right to bring proceedings elsewhere where applicable law gives you that right.
17. General Provisions
If part of these Terms is unenforceable, the remaining parts continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive the right to enforce it later. These Terms govern individual use of Kurate; any separate written agreement with Kivira applies to the extent it expressly provides different terms.
